Bill banning smoking in autos carrying children passes Assembly committee

SACRAMENTO (AP) - California could be the first state in the country to fine motorists who smoke while driving with young children in the car if a bill passed by an Assembly committee Wednesday becomes law.
The bill, passed by the Assembly Appropriations Committee and now on its way to the full Assembly, would lead to fines up to $96.

The bill would make it an infraction, punishable by a $25 fine for a first offense, to smoke a cigar, pipe or cigarette in a vehicle in which there was a child who was required to be carried in a protective seat. Subsequent violations could bring the fine up to $96.
Children who are younger than six or who weigh less than 60 pounds are required to be carried in the protective seats.

There is so much wrong with this. Can it be long before the legislature decides that it is unsafe for children to be in a home with smokers?
This Nanny-Statism keeps getting worse and worse. Who are these nut-case liberals who support all these ridiculous laws? And where is the common sense? Geez.
And one more thing. I can't imagine a 5-6 year old still in a car seat. My daughter was in the 96 percentile for height when she was litle - very tall and solid. At 4, I felt the manufacture's seat belt in my car protected her better than the after-market car seat. I had to explain that to a policeman once. He took one look at my daughter and agreed - after reminding me what the law was and warning me that I was in violation...
Yet, isn't this a wonderful country we live in because in about 2-3 years, she can get pregnant and have an abortion and I have no right to know about it. Whose child is she, anyway?

Only a matter of time before it becomes illegal to smoke if you have children... and from there illegal to smoke in the presence of children... and from there the definition of children will get expanded to cover everybody not receiving Social Security...

It would be interesting to see a competent actuary do an analysis of the risk of second hand smoke risk to a passenger in a car, compared to the risk of *merely* being in the car in the first place.
Carrying children in a car at all would be outlawed, since the risk is likely a whole order of magnitude greater.
